THE Purchaser thereby covenanted with the Vendor as follows:- (b) Not to erect or construct any dwellinghouse or other building on the said property or any part thereof without submitting the plans to the Vendor or his Surveyor and obtaining the approval of both the Vendor and his Surveyor as to the said plans and also as to the type nature and quality of materials to employed and the position to be occupied by the said buildings or dwellinghouses on the said property. A Conveyance of the land in this title dated 1 June 1954 made between (1) Florence Lily Kniveton and Thomas William Cain (Vendors) and (2) James Stuart Manning and Marion Kirkwood Manning (Purchasers) contains the following covenants:- "THE Purchasers (to the intent that the covenants by the Purchasers and the conditions hereinafter provided for may bind and be enforceable against the Purchasers also their successors in title and the persons deriving title under them and to benefit and protect the Vendors estate) hereby jointly and severally covenant with the Vendors and each of them (a) Not to use or permit to be used the said plot of land or any part thereof or any building erected thereon for any purpose which may cause any objectionable noise or smell or which may otherwise in the opinion of the Vendors be obnoxious or detrimental to the neighbourhood (b) To allow Purchasers of land adjoining the said plot of land to build into or upon any of the gables or boundary walls of any buildings to be erected on the said plot of land immediately adjacent to such adjoining land on payment to the Purchasers of one half of the cost of building such part of the gables and boundary walls as shall be so used and making good any damage occasioned thereby And that such gables and boundary walls shall thenceforth be treated as party walls .........................................................................
