A Conveyance of the land in this title and other land dated 3 July 1933 made between (1) Lancaster Corporation and (2) Frank Kelly (Purchaser) contains the following covenants:- COVENANT by the Purchaser with the Corporation that he the Purchaser his heirs and assigns would at all times thereafter observe and perform the said building and other conditions restrictions and stipulations in relation to the land and premises thereby conveyed THE SCHEDULE ABOVE REFERRED TO 1. The Purchaser shall erect and complete to the satisfaction of the Corporation or their Surveyor on the said land hereby conveyed substantial dwellinghouse of brick stone or other suitable material ......................................................................... No building of any description other than a boundary wall or bay windows or porches shall be erected on or over any part of the said plot of land lying between the building line marked on the plan annexed thereto and the roads abutting on such land and except a permitted or required by these conditions no building structure or erection whatsoever shall at any time hereafter be erected or built or permitted to be erected or built upon any other part of the said land without the written consent of the Corporation given in their capacity as Vendors of the land. 8. No trade or business shall be carried on upon the said land or any part thereof nor shall any poultry be kept thereon nor any act nor thing be done or suffered thereon which shall be a nuisance or annoyance to the owners or occupiers of adjacent hereditaments 9. All windows and lights opened or to be opened in any buildings on the land hereby conveyed which may overlook or derive light or air from other lands of the Corporation shall be deemed to be opened with the express consent of the Corporation and other the persons deriving title to such other lands from the Corporation and neither the enjoyment of such windows or lights for any length of time nor anything expressed or implied in this Conveyance shall entitled the Purchaser or his sequels in title to claim any absolute or indefeasible or other right to such light or air and such windows or lights shall not in any case become enjoyable as a right as against the other lands of the Corporation and no right to impede or control the erection of any buildings on such other lands or to claim any compensation from the obstruction of such lights or windows shall be acquired by the Purchaser or his assigns 10. No part of the said land shall be used as a billposting station nor shall any posters be displayed thereon 11. The dwellinghouses to be erected on the land conveyed shall not be converted into or in any way used as a shop or place of business of any description or kind whatever 12. The dwellinghouses to be erected upon the said land shall have a minimum frontage of 18 feet and front to Wellington Road aforesaid.
