What are the restrictive covenants on the property?                                                                                                  A Transfer of land lying to the north east of the land in this title and other land dated 13 October 1997 made between (1) Commission For The New Towns, (2) Heather Simpson and others (3) Barratt Manchester Limited and (4) P E Jones (Contractors) Limited contains the following covenants by the Transferors:- "The Commission so as to bind the whole and every part of the Commission's Retained Land hereby covenants with the Purchasers and the Executors so as to bind the whole and every part of the Executors' Retained Land hereby jointly and severally covenant with the Purchasers as set out in Schedule 4 PROVIDED THAT the Commission and the Executors (as the case may be) shall not be personally liable for any breach or omission of a restrictive covenant which may occur after it or they shall have parted with all interest (or granted a lease for a term in excess of one hundred and twenty five (125) years) in the Commission's Retained Land or the Executors' Retained Land (as the case may be) or the relevant part or parts thereof in respect of which a breach shall occur Schedule 4 Covenants by the Commission and the Executors with the Purchaser 1. Not to do or cause or permit to be done on the Commission's Retained land and the Executors' Retained Land (as the case may be) anything calculated or likely to cause damage or injury to the New Sewers and the New Works and to take all reasonable precautions to prevent such damage or injury 2. Not to make or cause or permit to be made any material alteration to or deposit of anything upon any part of the Commission's Retained Land and the Executors' Retained Land (as the case may be) so as to interfere with or obstruct the access thereto or to the New Sewers and the New Works or so as to lessen or in any way interfere with the support afforded to the New Sewers and the New Works by the surrounding soil including minerals or so as to materially to reduce the depth of soil above the New Sewers and the New Works 3. Not to erect or install or cause or permit to be erected or installed any building or structure or permanent apparatus in through upon or over a space on both sides of the New Sewers and the New Works as is required by the Regional Water Authority (or its duly authorised agents) except with the approval of the Regional Water Authority (or its duly authorised agents)." NOTE: The Executors Retained land referred to does not affect the land in this title The New Sewers referred to means (a) a new surface water sewer (b) new foul and surface water sewers and (c) the realignment of the existing foul sewer all beneath the surface of the land in this title. The New Works referred to means any manholes inspection chambers ancillary structures and associated equipment along the line or lines of the New Sewers on beneath or adjoining the land in this title.
