What are the restrictive covenants on the property? | A Conveyance of the land in this title dated 26 January 1874 made between (1) Richard Fisher and (2) William Fisher contains the following covenants:- "William Fisher doth hereby for himself his heirs executors and administrators covenant with the said Richard Fisher his heirs executors and administrators that he the said William Fisher his heirs or assign that any dwellinghouse to be erected on the land hereby conveyed shall be provided by the said William Fisher his heirs or assigns with a drain communicating with the main sewer available for the street so soon as such main sewer shall have been completed (if not completed previously to the building os such dwellinghouse) and such drains shall be of such size and shall be connected with the main sewer in such manner as shall be directed by such Surveyor as aforesaid And that any dwellinghouse or building to be erected on the piece of land hereby conveyed shall if attached to any other house or building have enter party wall on each side from the foundation to the ridging of the roof and the owner for the time being of land adjoining to any wall shall have liberty to make use of the same as a party wall upon payment of one half the value thereof to the height to which the same may be used such value in case of difference to be settled by the said Surveyor And further that he the said William Fisher his heirs or assign shall not use or suffer to be used any building for the time being standing uon the said land as a publichouse or beerhouse or for the exercise or carrying on of any offensive trade or business." |
