What are the restrictive covenants on the property?                                                                                                  A Conveyance of the land in this title and other land dated 9 November 1963 made between (1) John Butler and Mary Elizabeth Butler (Vendors) and (2) The Halifax Building Society contains the following covenants:- For the benefit and protection of Newbiggin Farm aforesaid (hereinafter called "the retained property") or any part or parts thereof and so as to bind so far as may be the property hereby conveyed the Purchaser for himself and his successors in title hereby covenants with the Vendors that he the Purchaser and his successors in title will henceforth observe and perform the restrictive and other covenants .................... set out in the First Schedule hereto Provided that the Purchaser shall not be liable for any breach or non-performance thereof occurring after he shall have parted with all his interest in the property hereby conveyed THE FIRST SCHEDULE before referred to:- 1. The Purchaser shall make a good and sufficient roadway leading from the land to Field number six hundred and eighty-nine over and along the portion of the land hereby conveyed coloured blue on the said plan and at all times to maintain and repair the said roadway at his own expense and will not park or permit to be parked on the said roadway any vehicle or cause or permit to be caused any obstruction of such roadway and in particular will do nothing which would block or diminish the light to the Vendors retained property so far as the same is adjacent to or adjoining such road 2. The Purchaser shall within three months of the date hereof erect a good and sufficient wall not less than three feet six inches nor more than four feet in height to the satisfaction of the Vendors between the points marked 'A' and 'B' on the said plan to divide the said roadway from that part of Field number six hundred and ninety-one retained by the Vendors 3. The Purchaser shall maintain all walls or fences marked with a 'T' placed inside the boundary of the land hereby conveyed as shown on the said plan in good repair and condition and so as to turn all stock 4. Every dwellinghouse or bungalow to be erected by the Purchaser upon the land hereby conveyed which forms part of a field number six hundred and eighty-nine shall be used only as a private residence with or without motor garage and the Purchaser shall not carry on or permit to be carried on on the said premises any trade or business whatsoever or use or permit the said premises to be used as a public house or beer house or for the sale of wine or spirituous liquor nor for any purpose which may cause more noise smoke disagreeable odours or noxious vapours than would be caused by user thereof as a private dwellinghouse or residence nor for any purpose which may become a nuisance or annoyance or detrimental to the neighbourhood Provided that this restriction shall not preclude a Doctor from carrying on his profession on such premises 5. The Purchaser shall before erecting any dwellinghouses or bungalows on the land hereby conveyed obtain at his own expense all necessary Planning or other consents 6. No goats pigs poultry or other livestock (other than dogs or cats) shall be kept in or upon the property hereby conveyed or any dwellinghouses or bungalows to be erected thereon NOTE: The land in this title forms part of field 689 referred to. No blue colouring T marks nor points marked A and B were shown on the plan supplied on first registration.
