| What are the restrictive covenants on the property? | A Conveyance of the land in this title dated 4 November 1969 made between (1) Clifford Albert Robinson (Vendor) and (2) Brian John Morris and Marilyn Morris (Purchasers) contains the following covenants:- "The Purchasers (for the benefit and protection of the estate of the Vendor at or near Boyes Avenue Catterall aforesaid or any part or parts thereof and so as to bind so far as may be the property hereby conveyed into whosesoever hands the same may come) hereby jointly and severally covenant with the Vendor that they the Purchasers and their successors in title will at all times hereafter observe and perform the restrictions and stipulations set out in the First Schedule hereto but so that the Purchasers shall not be liable for any breach of restrictive covenant occurring on or in respect of the property hereby conveyed or any part or parts thereof after they shall have parted with all interest therein The First Schedule referred to (1) The Purchasers shall erect on the said plot of land hereby conveyed not more than one dwellinghouse or bungalow only and all buildings to be erected on the said plot of land shall be built according to building lines to be approved by the Vendor or his Surveyor and the space in front of the said building line shall for ever hereafter remain unbuilt upon except for bay windows steps or porticoes which shall not project more than four feet six inches or for a terrace retaining wall and the same space shall be enclosed by a suitable wall with or without iron or wood palisades thereon to be approved by the Vendor or his Surveyor (2) The dwellinghouse or bungalow to be erected on any part of the said land shall be built of stone brick or roughcast with slate or tile and other good materials to be approved by the Vendor or his Surveyor (3) No stall booth shed or any table board or other structure for the purpose of selling or exposing for sale goods of any kind whatsoever shall be placed or set up on any part of the land hereby conveyed by and the Purchasers or their successors in title or assigns or by any person by their permission (4) No building erected upon the said plot of land shall be used as a shop warehouse for trade or business purposes and no building so erected shall be used fro the sale to be consumed on or off the premises of ale beer or spirituous or excisable liquors or as a public dancing room or singing room or for any purpose which might be noisy noisome or detrimental to the neighbourhood and no stable cow shed pig stye goat house or poultry house shall be erected thereon but nothing herein contained shall prevent the Purchasers or their successors in title from erecting on the said plot of land in respect of and as an adjunct to such dwellinghouse or bungalow a motor garage to be used for private purposes only and not for business purposes (5) No pigs poultry pigeons or goats shall be kept upon any part of the land hereby conveyed (6) No advertisements hall be posted or painted or in any way displayed upon any dwellinghouse or building which might be erected upon the said plot of land or on any hoarding advertisement board or in any other way upon the said plot of land except the name of the owner or tenant and his profession or business and the name of the house or from time to time that the house is for sale or to be let (7) The plans and elevations of all buildings to be erected on the said plot of land shall be submitted to the Vendor or his Surveyor for approval and no building erected upon the said plot of land shall be built unless and until such plans are passed and signed by one or the other of them" |
