| What are the restrictive covenants on the property? | A Conveyance of the land tinted pink on the filed plan and other land dated 7 April 1877 made between (1) William Sumner and William Bullough (2) William Sumner and (3) William Ascroft (the Purchaser) contains the following restrictive covenants:- "That no bricks tiles or other manufacture from clay shall be made burnt or carried on upon the said hereditaments and premises." ......................................................................... "That the Purchaser shall provide for the drainage of the said hereditaments and premises so that no water can flow on to any adjoining allotment or on to the roads That all buildings shall be effectually drained and sewered That the purchaser shall be at liberty to lay into the main sewer adjoining the said hereditaments and premises when made but shall not use the side drains except for agricultural purposes 7. That all houses erected on the said hereditaments and premises shall be erected parallel to and back from the adjoining road or roads not less than 21 feet and shall not be of less value than £100 each exclusive of land that nothing shall be built nearer to the road than 21 feet 8. That not more than two dwellinghouses shall be erected upon one allotment 9. That no building shall be erected or used for the sale of ale beer wine or spirituous liquors That no offensive trade or manufacture shall be carried on upon any allotment." A Transfer of the land in this title and other land dated 28 November 2005 made between (1) Preston City Council (Transferor) and (2) Community Gateway Association Limited (Transferees) contains the following covenants:- "10.4 TRANSFEREE'S COVENANTS The Transferee covenants with the Transferor as follows: 10.4.1 With the object and intent of affording the Transferor a full and sufficient indemnity but not further or otherwise to hereafter observe and perform the Restrictions insofar as they relate to or affect the Property and are still subsisting and capable of being enforced and keep the Transferor fully and effectually indemnified from and against all actions proceedings costs charges claims demands and liabilties whatsoever in respect of any future breach or non-observance or non-performance of them. 10.4.2 That upon the sale of a freehold or leasehold interest by the Transferee of any part of the Property to a tenant of that part of the Property pursuant to the Right to Buy the Transferee will so far as the law allows from time to time obtain from that tenant and to the intent and so as to bind that part of the property into whosoever hands the same may come a covenant by that tenant to observe and perform covenants consistent with and no less onerous than those set out below PROVIDED THAT it is hereby agreed and declared that the Transferee and all other persons deriving title under it including (inter alia) any mortgagee chargee or receiver of the Transferee (other than tenants acquiring pursuant to the Right to Buy parts of the Property) and any of their successors in title or of the Property shall not themselves be bound by any of the said covenants. The covenants are: (1) not to display any advertisement hoarding notices on the Property or any part thereof except from time to time notices that the Property is for sale or to let as the case may be; (2) not to place or permit to be placed any boat, caravan or heavy commercial vehicle upon the front garden drive accessway or forecourt of the Property; (3) not at any time (without the written consent of the Association) to carry on or suffer to be carried on the Property or any part thereof any trade or business whatsoever or permit the same to be used for any other purpose than as a private dwellinghouse, AND the definitions referred to in the covenants shall be as follows: "Association" means Community Gateway Association Limited "Property" means the property being transferred 10.4.3 Not to dispose of the Property or any part thereof except with the consent of the Secretary of State for the Office of the Deputy Prime Minister or from any other person succeeding the Secretary of State as being the person empowered to give consent for the disposal of the Property and for the avoidance of doubt the Transferee shall only be required to obtain such consent for so long as the Secretary of State has the jurisdiction and the power so to do PROVIDED THAT no such consent shall be required if the disposal is an exempt disposal as defined in section 81 (8) of the Housing Act 1988 or any similar successor legislation. 10.4.4 To maintain and keep in repair all private roads, parking spaces, footpaths and accessways forming part of the Property and which from time to time serve the Retained Land and the kerbs, pavements, street lighting, signposting and notices thereon. 10.4.5 To maintain and keep in repair all private Service Conduits forming part of the Property which serve the Retained Land. 10.4.6 The Transferee (here meaning Community Gateway Association Limited only) covenants with the Transferor to give notice to the Transferor of any Disposal other than an Exempt Disposal occurring within 30 years of the date of this Transfer with a certified copy of the complete disposal document within 10 working days of completion of such Disposal. This covenant shall only apply to Community Gateway Association Limited and shall not bind its successors in title, or any Mortgagee of the Transferee or of the Property or any receiver appointed by such Mortgagee or any persons deriving title through such Mortgagee or receiver. |
