NO houses or buildings shall be erected on any portion of the said plots of land unless and until the plan thereof shall be submitted to and approved by the said James Wilson or his Surveyor and in the event of this stipulation not being carried out the said Edward Thompson shall pay to the said James Wilson the sum of twenty pounds NO building shall be erected of less than two stories high and no building shall be used for any purpose which may cause any disagreeable smell or be noisy noisome or detrimental to the neighbourhood NO shop shall be built upon the said plots of land nor shall any building erected thereon be used as a shop or warehouse for business purposes or for the sale of ale beer or spirituous liquors THE gable wall of the most Southerly of the two dwellinghouses to be erected on the said plots of land shall be placed nine inches on the adjoining plot of land and shall be considered as a party wall and the value of nine inches in thickness of such wall shall be repaid to the said Edward Thompson by the Purchasers of the adjoining plot when the wall is made use of such value in case of dispute to be determined by the said James Wilson his Surveyor and accepted by the respective Purchasers.
