A Conveyance of the land in this title and other land dated 22 July 1938 made between (1) Samuel James Millard (Vendor) (2) James Melville and others and (3) Frank Sugden (Purchaser) contains the following covenants:- "Covenant by the Purchaser further with the Vendor for the benefit of the adjoining and neighbouring estate of the Vendor and the property of the Vendor in Bradford Street Chester Street and Grosvenor Street Ormsgill aforesaid that he the Purchaser and the persons deriving title under him would not carry on or permit to be carried upon any premises erected upon the piece of land thereby conveyed any trade or business whatsoever or use or permit the same to be used for any other purpose other than as a private dwellinghouse."
