THE FIRST SCHEDULE before referred to 1. No structure of any kind safe and except detached or semi detached dwellinghouse with the usual outoffices thereto should at any time be erected upon the said plots of land coloured pink and brown on the said plan nor should any structure of any kind save and except dwellinghouses and or shops with the usual outoffices thereto at any time be erected upon the said plot of land coloured green on the said plan. The expression "Outoffices" included motorhouse provided there be not more than one motor house to each dwellinghouse and or shop and the same be used only as an adjunct to and in connection with such dwellinghouse and or shop and save in the case of a motor house erected as an adjunct to a shop erected on the said plot of land coloured green on the said plan) for the private use of the occupier thereof only and not for business or trading purposes. 2. Not more than 6 persons of semi-detached dwellinghouses or 12 detached dwellinghouses should be erected on the said plot of land coloured pink on the said plan. 3. All buildings on the said plot of land coloured pink on the said plan should be erected according to plans and elevations and with materials and in positions previously approved of by the Vendor's Surveyor 4. No dwellinghouse and or shop or premises of semi-detached dwellinghouses and or shops should be erected on the said plots of land coloured pink brown and green on the said plan within a distance of 20 ft of any other dwellinghouse and or shop or premises of semi detached dwellinghouses and or shops and their should be no building or erection whatsoever upon the open spaces between such dwellinghouse and or shops or premises of semi-detached dwellinghouses and or shops. 5. The should be no building or erection whatsoever on the said plots of land coloured pink brown and green on the said plan nearer Heysham Road than 30 ft nor nearer the Northerly or Southerly boundaries of the said plot of land coloured pink (within a distance of 70 ft of Heysham Road) than 10 ft. 6. The said plots of land coloured pink and brown on the said plan should not nor should any building to be erected thereon or on any part or parts thereof be at any time used for a shop or for any trade or business and such plots of land and the said plot of land coloured green on the said plan should not nor should any building to be erected thereon or on any part or parts thereof be at any time used for the keeping of poultry or for any purpose which should or might be or might grow to be in any way a nuisance damage grievance or annoyance to the vendors or the neighbourhood. Provided always that this condition should not prevent poultry being kept not less than 100 ft from Heysham Road and for the private use of the occupiers of the said dwellinghouse and or shops only and not for business or trading purposes. 8. The Vendor's reserved the right to deal with the rear of their estate in such manner as they should think fit and to sell the same either with or without conditions as to user buildings to be erected thereon roads sewers or otherwise as they should think fit and they should not be in any way restricted by those presents excepting as thereby expressly provided. NOTE: The land in this title falls wholly within the land coloured pink referred to. |
