| What are the restrictive covenants on the property? | A Conveyance of the land in this title dated 10 March 1943 made between (1) Ellen Morris (Vendor) and (2) James Kitchen and Martha Kitchen (Purchasers) contains the following covenants:- "WITH the object of affording to the Vendor a full indemnity in respect of any breach of any of the said reservations restrictions conditions and agreements set forth in the Schedule hereto but not further or otherwise the Purchasers HEREBY jointly and severally COVENANT with the Vendor tha tthe Purchasers and their successors in title will henceforth perform and observe the said reservations restgrictions conditions and agreemenets and will indemnify the Vendor against all actions and claims in respect of the same so far as they affect the plot of land and premises hereby assured and are still subsisting and capable of taking effect THE SCHEDULE referred to 2. No building or erection of any kind shall be set up on the said plot of land northerly of the line running parallel to the road leading from Hest Bank to Bolton-le-Sands and marked Building Line except bay windows steps porticoes or verandahs nor shall any such building or erection be set up thereon nearer to the intended road (marked Hatlex Drive on the said plan) between the points D and B than twenty-fourfeet except as aforesaid 3. NO building of any kind other than private dwellinghouses with private garage to each and other appropriate offices and outbuildings to be appurtenant thereto and occupied therewith shall be erected on any part of the said plot of land and no trade or business of any kind shall be carried on upon any part thereof 4. NO more than one pair of semi-detached houses shall be erected on the westerly side of the said intended road called Hatlex Drive on the said plan and no more than trwo pairs of semi-detached houses shall be erected on the easterly side of the said intended road and a distance of twenty-four feet at least shall be left between each pair of semi-detached houses 5. ALL houses built on the said plot of land shall not be more than two storeys in height and this shall apply to all other buildings 6. ALL houses to be erected on the said plot of land shall be built according to plans elevation proposed lay out and mode of construction to be approved by the vendors or their Architect or Agent before the work of building is commenced and shall bt built to the satisfaction of the vendors or their Architect or Agent and this shall also apply to all other buildings 7. NO additions to or structural alterations of the said messuages and outbuildings shall at any time hereafter be made without the previous consent in writing of the Vendors their heirs or assigns 8. NO poultry nor livestock of any kind shall be kept except at the rear of the messuages proposed to be built and not nearer than fifty feet from the said intended road" NOTE: The building lines follow the existing lines of the building. |
