| What are the restrictive covenants on the property? | A Conveyance of the land in this title and other land dated 11 May 1937 made between (1) The Lancaster Banking Company Limited (2) District Bank Nominees Limited (3) District Bank Limited (4) The Morecambe Regent Park Estate Limited (Vendors) and (5) Hudson Brook and Alice Brook (Purchasers) contains the following covenants:- COVENANT by the Purchaser with the intent so far as possible to bind the said plot of land thereby conveyed into whosoever hands the same might come and to benefit and protect the adjoining or neighbouring property of the Vendors with the Vendors that they the Purchasers would at all times thereafter observe and perform the conditions contained in the First Schedule thereto THE FIRST SCHEDULE before referred to ......................................................................... 4. THAT the Purchasers and their successors in title would build and complete to the satisfaction of the Vendors or their Surveyors upon the said plot of land thereby conveyed with brick or stone slate and other good materials three dwellinghouses only and such dwellinghouses shall be of an elevation and design approved of by the Vendors or their Surveyors and should also be in such line and have threshholds of such levels as might be fixed by the Vendors or their Surveyors and should front to Buckingham Road or Devonshire Road aforesaid and no other buildings other than the said dwellinghouses and usual outoffices should be erected on the said plot of land thereby conveyed and that previous to the erection upon the said plot of land thereby conveyed of any buildings or walls the Purchasers should submit plans and elevations thereof and obtain the approval in writing thereto by the Vendors or their Surveyors 5. THAT a space of not less than 15 feet in width between such dwellinghouses and the palisade line shown on the said plan and of seven feet 6 inches in width on the north easterly and ten feet on the north westerly sides thereof within a distance of 40 feet from the palisade line should be left open and unbuilt upon except for bay windows steps or porticoes 6. TO erect and thereafter maintain a brick or stone or roughcast boundary wall not exceeding 3 feet in height above the footpath abutting upon the said roads 7. THAT no part of the said plot of land thereby conveyed or any building to be erected thereon should be used for a shop or business purposes or for a licensed house or for a pigstye or for any purpose which might be in anywise a nuisance or annoyance to the owners or occupiers of the adjoining property or the neighbourhood which might tend to depreciate or lessen the value of the adjoining property belonging to the Vendors or any Purchaser from them or any part thereof as a residential property and that no poultry should be kept on the said plot of land thereby conveyed. |
