The following are details of the covenants contained in the Deed of Covenant dated 15 February 1897 referred to in the Charges Register:The Purchasers for himself his heirs executors and administrators and (as to such of the stipulations contained in the First Schedule hereto as are in their nature restrictive or capable of being enforced against a Purchaser with notice) for his assigns hereby covenants with each and every two and more of the other purchasers his and their respective heirs and assigns and also as a separate covenant with the Vendors their heirs and assigns that he the Covenantor and (as to such of the said stipulations as aforesaid) his assigns and all persons deriving title under him or them respectively will at all times hereafter perform and observe such of the stipulations contained in the First Schedule hereto as are applicable to the lot or lots purchased by him THE FIRST SCHEDULE above referred to Stipulations and Conditions ....................................................................... .. 5. No building shall at any time be erected on Lots 1A, 2, 3, 4, 5, 6 and 10 except dwellinghouses with the usual outoffices thereto and all dwellinghouses and buildings to be erected on any of the said lots shewn on the said plan (other than Lot 1 or Lots 1, 1A and 2 if sold together) shall be built according to the building line shewn on the said plan and marked "Building Line" or except in accordance with plans and elevations which have been previously submitted to and approved by the Surveyors at the expense of the purchaser of such Lot and no palisades shall be erected on any Lot (other than Lot 1 or Lots 1, 1A and 2 if sold together) except in accordance with the palisade lines shewn on the said plan and of a character approved by the Surveyors at the expense of the Purchaser of such Lot 6. No dwellinghouse shall be erected on any of the Lots numbered 1A, 2, 3, 4, 5, 6 and 10 (other than Lots 1A and 2 if sold together with Lot 1) of a less annual rateable value than hereinafter mentioned that is to say On lots 1A and 2 fronting to the sea shore £35 On Lots 3, 4 and 10 fronting to Heysham Road £27 On the remainder of Lots 3, 4 and 10 also Lot 5 £18 and on Lot 6 £15 All such dwellinghouses shall be of an uniform elevation and shall have stone fronts and bay windows as may be approved by the Surveyors 7. No building erected on any of the said Lots numbered 1A, 2, 3, 4, 5, 6, and 10 (other than Lot 1 or Lots 1, 1A and 2 if sold together) shall be at any time used or occupied as a shop public house or beershop or for any trade or business purposes except that the corner houses of each lot (other than on the sea frontage of Lots 1A and 2) may be used for shops but no such shops or any dwellinghouse or building to be erected on the remaining lots shewn on the said plan shall be used for carrying on any noisome or offensive trade or business.
