(03.01.2008) The following are details of the covenants contained in the Transfer dated 31 March 2005 referred to in the Charges Register:- "13.3 Restrictive Covenants by the Transferee The Transferee to the intent and so as to bind the Property into whosoever hands the same may come hereby covenants with the Transferor for the benefit of the Retained Land and each and every part thereof to observe and perform the restrictions stipulations covenants conditions and other matters as set out below a.(i) Not to use or occupy the Property or any part or parts thereof or permit or suffer the same to be used or occupied for any purpose other than for development and use as 16 Residential Units in accordance with outline planning permission number 03/01434/OUTMAJ or such permission as shall be granted for the provision of 16 Residential Units on an amended permitted development site area within the Property ("the Existing Planning Permission") (ii) Without prejudice to the generality of the foregoing not to carry out any development on the Property or any part or parts thereof or permit or suffer the same to be developed save for such development (if any) as shall be consistent with the use or occupation of the Property in accordance with the Existing Planning Permission. b. Not cause or allow to be or to be done on the Property anything which shall be or may be deemed to become a danger, nuisance, obstruction, annoyance or inconvenience to the Retained Land or any part thereof or to the occupiers thereof c. Not prevent the retrieval from the Property of apparatus including but not limited to balls and other sporting equipment emanating from the Retained Land. NOTE: The Property means the land in this title and other land. The Retained Land means the land retained by the Transferfor. The Residential Unit means a self contained flat, bedsit, house, maisonette or bungalow. The School means the school situated within the Retained Land. The Access Road is shown tinted brown on the title plan."
