A Conveyance of the land in this title and other land dated 5 December 1977 made between (1) James Rafton Smallwood and Josephine Smallwood (Vendors) and (2) Eardley Builders (Morecambe) Limited (Purchasers) contains the following covenants:- THE Purchasers hereby covenant with the Vendors that the Purchasers and the persons deriving title under them will at all times hereafter observe and perform the restrictions and stipulations set out in the First Schedule hereto but so that neither the Purchasers nor those deriving title under them shall be liable for a breach of this covenant occurring on or in respect of the property hereby conveyed or any part or parts thereof after they shall have parted with all interests therein. .........................................................................
