A Conveyance of the freehold estate in the land in this title and other land dated 15 May 1956 made between (1) Marjorie Jean Michaelson Yeates and Winifred Mary Northover (Vendors) and (2) A Robinson & Sons (Morecambe) Limited (Company) contains the following covenants:- FOR the benefit of the remaining land of the Vendors the Company (with the intent to bind all persons in whom the said property thereby conveyed should for the time being be vested) thereby covenanted with the Vendors that the Company would at all times thereafter duly observe and perform the building restrictive and other conditions set out in the First Schedule thereto THE FIRST SCHEDULE thereinbefore referred to 1. No buildings of any kind other than private dwellinghouses or bungalows with appropriate outoffices outbuildings and garages to be appurtenant thereto and occupied therewith should be erected on the property thereby conveyed and no trade or business of any kind should be carried on upon any part thereof 2. Not more than 52 dwellinghouses or bungalows should be erected on the property thereby conveyed which dwellinghouses or bungalows should not be erected nearer to Morecambe Road aforesaid than 36 feet or nearer to Stanhope Avenue and Homfray Grove aforesaid than 15 feet or nearer the portion of the north-westerly boundary marked a-b on the said plan or near the south-easterly boundary than 10 feet within a distance of 80 feet of Morecambe Road aforesaid or nearer the portions of the north-westerly boundary marked C-D and E-F on the said plan than 8 feet within a distance of 60 feet of Homfray Grove and Stanhope Avenue aforesaid respectively and there being a minimum distance of 20 feet between such dwellinghouse or bungalows (if detached) with the outhouse and garage belonging thereto or between each pair of dwellinghouses or bungalows (if semi-detached) with the outbuildings and garages belonging thereto within a distance of 80 feet or Morecambe Road aforesaid in respect of the dwellinghouses or bungalows erected fronting to Morecambe Road aforesaid and there being a minimum distance of 16 feet between each dwellinghouse or bungalow (if detached) with the outhouse and garage belonging thereto or between each pair of dwellinghouses or bungalows (if semi-detached) with the outbuildings and garage belonging thereto within a distance of 60 feet of Stanhope Avenue and Homfray Grove aforesaid in respect of all dwellinghouses or bungalows fronting to those roads respectively 3. The lay-out-plan elevations and mode of construction of the said dwellinghouses or bungalows outoffices outbuildings and garages should be submitted by the Company and approved by the Vendors or their Surveyors Messrs. Harrison Willis and Moore or Morecambe and Heysham or other the Surveyors whom the Vendors should from time to time appoint before commencing building on the property thereby conveyed and the said dwellinghouses or bungalows outoffices outbuildings and garages should be constructed strictly in accordance with such approved plans elevations and mode of construction. ......................................................................... 6.
