A Conveyance dated 19 October 1896 made between (1) James Fish and (2) James Cardwell and others contains the following covenants:- The Purchasers shall not use the hereditaments and premises hereby conveyed or any part thereof or erect any buildings upon the said hereditaments and premises hereby conveyed or any part thereof which shall be used for any purpose which may in the fair and reasonable opinion of the Vendor his heirs or assigns be a nuisance or injurious or detrimental to the adjoining hereditaments of the Vendor but this shall not preclude the Purchasers from making bricks or tiles on the hereditaments and premises hereby conveyed so long as such making of bricks or tiles shall not become a nuisance at Common Law. The Vendor shall not use the hereditaments adjoining the hereditaments and premises hereby conveyed on the southerly side thereof for a distance of one hundred and seventy five yards from the southern boundary of the hereditaments and premises hereby conveyed or erect any buildings upon the said adjoining hereditaments or any part thereof which shall be used for any purpose which may in the fair and reasonable opinion of the Purchasers their heirs or assigns be a nuisance or injurious or detrimental to the hereditaments and premises hereby conveyed but this shall not preclude the Vendor from making bricks or tiles on the said hereditaments adjoining to the hereditaments and premises hereby conveyed so long as such making of bricks or tiles shall not become a nuisance at Common Law. A Conveyance dated 7 August 1929 made between (1) The Mayor Aldermen and Burgesses of the Borough of Blackpool and (2) Fred Kay contains covenants. NOTE: Copy filed.
