A Conveyance of the land in this title dated 27 January 1967 made between (1) Preesall Properties Limited (Vendors) (2) Albert Victor Waits and Nora Waits (Purchasers) contains the following covenants:- "THE Purchasers (for the benefit and protection of the Vendors Scorton Estate of which the property hereby conveyed forms part or any part or parts thereof and so as to bind so far as may be the property hereby conveyed into whosoever hands the same may come) hereby jointly and severally covenant with the Vendors (but so that the Purchasers shall not be liable for any breach of this covenant occurring in respect of the property hereby conveyed after they shall have parted with all interest therein) that they the Purchasers and their successors in title will at all times hereafter observe and perform the conditions and restrictions contained in the First Schedule hereto THE FIRST SCHEDULE hereinbefore referred to (a) No building or buildings to be erected upon the property hereby conveyed or any part or parts thereof shall (without the consent in writing of the Vendors) be used for any other purpose than that of a private dwellinghouse with the usual outbuildings thereto (b) No building or erection shall be built or placed upon the property hereby conveyed within ten years from the date hereof unless plans and elevations of every such building or erection shall first be submitted to and approved in writing by the Vendors and a fee of Two Guineas paid in respect of each plan for such approval. (c) No trade shall be carried on nor shall any advertising sign or hoarding be erected or displayed on any part of the property hereby conveyed (other than and except a notice that the property is for sale or to let as the case may be) without the consent in writing of the Vendors (d) The Purchasers shall not acquire any right of light or air or other easement over any of the adjoining or neighbouring property now or formerly belonging to the Vendors except such rights as are herein contained (e) The walls and fences which shall separate the property hereby conveyed from the adjoining properties now or formerly belonging to the Vendors and any roofs spouts fallpipes chimney stacks gutters drains and sewers which shall hereafter be used jointly by any building to be erected on the property hereby conveyed and any such adjoining properties shall be party walls fences roofs spouts fallpipes chimney stacks gutters drains and sewers and shall henceforth be so used treated cleansed maintained and repaired accordingly"
