A Transfer of the land in this title dated 5 December 1997 made between (1) Chorley Borough Council (The Transferor) and (2) The North British Housing Association Limited contains the following covenants:- "The Transferee covenants with the Transferor to the intent that the burden of this covenant may run with and bind the Property and every part thereof and to the intent that the benefit thereof may be annexed to and run with the Transferors neighbouring land and estate as follows:- (a) Not at any time to use the Property or any part thereof otherwise than for private residential purposes and the formation of a childrens play area and footpath link to Portsmouth Drive (b) Not to erect any building or buildings on the Property except in such position and in accordance with such plans elevations sections and specifications of such building or buildings respectively including building lines and points of access as shall be submitted by the Transferee to and be required and approved by the Transferor as landowner (such approval not to be unreasonably withheld or delayed) or by the Local Planning Authority for the district prior to the commencement of such building or buildings (provided that once the Transferee has let a building contract the Transferors approval as land owner but not as Local Planning Authority shall not be required to any subsequent variation or change) and to keep and maintain the Property and any building or buildings thereon in good repair and condition and (i) Not without such approval as aforesaid after completion of such building or buildings erected as aforesaid to erect any other building or buildings whatsoever on the Property (other than any usual domestic outbuildings for which no specific approval is required under the Town and Country Planning Acts or General Development Orders) or any part thereof or make any material additions to the said building or buildings (ii) An addition shall be material for the purposes of sub clause (i) above if the addition requires any specific approval to be obtained under the Town and Country Planning Acts or General Development Orders."
