A Conveyance of the land in this title and other land dated 9 December 1998 made between (1) Philip Samuel Sandham and Alan William Frederick Shellcross (Vendor) and Mac Construction Limited (Purchaser) contains the following covenants:- "THE Purchaser covenants with the Vendor and their successors in title to the Retained Land so as to bind the owner for the time being of the land hereby conveyed and for the benefit of the Retained Land and each and every part thereof not to develop the land hereby conveyed or any part of it in such a way as to diminish the light or air enjoyed by the Retained Land to any substantial degree PROVIDED ALWAYS that the development of the land hereby conveyed for residential purposes or other purposes consistent with the provisions of the Section 106 Agreement dated the Thirty-first day of January 1996 and made between the Vendor, the Purchaser and the several other parties therein named shall not be regarded as a breach of this covenant."
