A Conveyance of the land in this title and other land dated 21 December 1895 made between (1) William Henry Park and John Robert Park and (2) Stephen Hart Jackson and Malachi James Cranke contains the following covenants:- COVENANT by the said Stephen Hart Jackson and Malachi James Cranke with the said William Henry Park and John Robert Park that every building erected or to be erected upon any piece of land thereby conveyed which should adjoin any land the property of the said William Henry Park and John Robert Park should have entire party walls on such side as adjoins the land of the said William Henry Park and John Robert Park from the foundations to the ridging of the roof and every such wall should be built as to one half thereof on the land thereby conv yed and as to the other thereof on the djoining land of the said William Henry Park and John Robert Park and the owner for the time being of the land adjoining to any such walls should have liberty to make use of the same as party wall upon payment to the said Stephen Hart Jackson and Malachi James Cranke of one half of the value thereof to the height to which the same might be used such value in case of difference to be settled by two valuers one to be appointed by each party or their umpire and that every dwellinghouse which should be built upon the piece of land marked "H" on the said plan should be built with the front thereof up to a building line to be agreed upon by the said Willkiam Henry Park and John Robert Park Stephen Hart Jackson and Malachi James Cranke and in case the said parties could not agree upon such building line the same should be settled by two valuers one to be appointed by each party or their umpire And further that no building erected or to be erected upon any party of the of the said land thereby conveyed should be used as a public house or beerhouse or otherwise for the sale of intoixicating liquors or for the exercise or carrying on of any offensive trade or business NOTE: No piece of land marked 'H' was shown on the plan supplied on first registration.
