A Conveyance of the land in this title dated 1 April 1932 made between (1) Harry Brook and Ernest Kershaw (Vendors) and (2) Mary Hannah Foxton (Purchaser) contains the following covenants:- "Subject also to the restrictive and other stipulations and conditions set forth in the Schedule hereto The Purchaser hereby covenants with the Vendors that she and her successors in title the owners or occupiers for the time being of the land hereby conveyed will at all times hereafter observe and perform the said stipulations and conditions The Schedule before referred to:- ......................................................................... 4. The Purchasers shall observe the building and palisade lines shown on the said plan. 5. No Hotel public-house beershop shop nor any stable factory nor workshop shall be erected on any part of the said plot of land nor shall the sale of ale beer wine spirits or other alcoholic liquors take place thereon or on any part thereof nor shall any part thereof be used or occupied as a fried or chipped potato shop or for any purpose which may be noisy noisome objectionable or detrimental to the neighbourhood. 6. No building shall be commenced upon any part of the said plot of land until plans and elevations thereof shall have been first submitted to and approved in writing by the Vendors or their Surveyor. 7. The Vendors expressly reserve the right to sell the remainder of their land forming part of the Moss House Estate or any portion thereof with such variations of the above conditions as they may think fit or free from all conditions whatsoever."
