A Conveyance dated 28 November 1859 made between (1) The Most Noble The Duke of Beccleugh and Queensberry (2) The Earl of Dalkeith and (3) Thomas Trainer Woodburne and others contains restrictive covenants but neither the original deed nor a certified copy or examined abstract thereof was produced on first registration. A Conveyance of the land in this title and other land dated 3 July 1875 made between (1) John Poole and William Park and (2) Joseph Jukes contains the following covenants:- COVEANNTS by the said J Jukes that he the said J Jukes his heirs or assigns that every dwellinghouse if attached to any or should have entire party walls on each side and the owner for the time being of the said land adjoining to any wall should have liberty to use the same on payment of one half the value thereof to the height used such value in case of dispute to be settled by the said Surveyor AND that every dwellinghouse should be built with front up to the 'building line' shown on the plan and according to elevation and plan previously approved AND FURTHER that said J Jukes his heirs or assigns should not use or suffer to be used any building for the time being standing upon the said land as a Public House or Beer House or for the sale of any intoxicating liquors or for the exercise or carrying on of any offensive trade or business NOTE: The 'building line' referred to is the existing line of buildings.
