A Conveyance dated 5 July 1880 made between (1) Thomas Woodburne and William Park (Vendors) and (2) Benjamin Fish contains the following covenants:- COVENANTS by the said Benjamin Fish that no building should be used as a public house or beerhouse or otherwise for the sale of any intoxicating liquors or for the exercise or carrying on of any offensive trade or business. By the Conveyance dated 5 July 1880 referred to above the land was conveyed subject as follows:- Subject to the reservations terms and conditions contained in an Indenture of Enfranchisement of the said premises with others dated the 28th day of November 1857 and made between the Duke of Buccleuch and Queensberry of the 1st part the Earl of Dalkeith of the 2nd part and Thomas Trainer Woodburne Robert Ashburner and William Robinson of the 3rd part. NOTE: No further particulars of the said Indenture of Enfranchisement dated 28 November 1857 referred to were supplied on first registration.
