A Conveyance of the land in this title dated 20 November 1929 made between (1) Sidney Shackleton and (2) Joseph Clough contains the following covenants:- "THE Purchaser hereby covenants with the Vendor that he the Purchaser will at all times hereafter observe and perform the said conditions and restrictions contained in the said First Schedule hereto. ......................................................................... THE Purchaser or his successors in title will not erect on the premises hereby conveyed at any time any building other than one detached or semi-detached dwellinghouse with or without a private garage and no dwellinghouse shall be erected except in accordance with the building line shown on the said plan. No such building shall at any time hereafter be used for any purpose other than as a private dwellinghouse and private garage without the written consent of the Vendor having bee previously obtained. The plans of all buildings to be erected at any time on the land hereby conveyed shall be submitted to and approved by the Vendor or the persons claiming under him before the erection of such buildings. all such buildings shall be of brick and pebble-dashed or brick or stone and slated or tiled. 2. NO poultry or pigeons shall be kept on the premises hereby conveyed without the written consent of the Vendor or the persons claiming under him having been previously obtained and the Purchaser shall not permit or suffer thereon any nuisance or disturbance or anything likely so to be to the annoyance or detriment of the adjoining property or the occupiers thereof. 3. THE division walls and fences separating the property hereby conveyed from the adjoining property shall be joint party division walls and fences and shall be used and maintained as such accordingly."
