A Conveyance of the land in this title and other land dated 13 March 1908 made between (1) Right Honourable Sir John Tomlinson Hibbert and others (2) The Barrow Haematite Steel Company Limited (Company) and (3) James Cox contains the following covenants:- COVENANT by the said James Cox with the Company their successors and assigns that he the said James Cox his heirs or assigns would forthwith erect upon the said land coloured dark pink on the said plan dwellinghouses or shops and would expend upon the construction or every such dwellinghouse or shop a sum of not less than £112 And that every such dwellinghouse and shop be built according to and elevation and plan approved by the Company or their Surveyor or Agent And that the dwellinghouse or shop to be erected nearest to the boundary marked A.B. should have party walls on each side and the owner for the time being of the land adjoining to any such party wall should have liberty to make use of the same on payment of one half of the value thereof And further that the said dwellinghouse or shop nearest to the said boundary marked A.B. should not have any window or lights overlooking the said adjoining land then belonging to the Company And further that the said James Cox would not without the consent of the Company erect any house or building or use or suffer to be used any house or building or use or suffer to be used any house or building for the exercise or carrying on of any offensive trade business or for a public house or beerhouse NOTE: The boundary AB referred to is not a boundary of the land in this title.
