A Conveyance of the land in this title and other land dated 6 December 1898 made between (1) Thomas Gardner Thompson, the younger (the vendor) and (2) Simeon Waites (the purchaser) contains the following covenants:- 5. The Purchaser shall be at liberty to build upon the said plot of land not more than four dwellinghouses with the usual outoffices thereto Every such dwellinghouse shall be built with brick or stone slate and other good materials in a good and substantial and workmanlike manner and when completed of not less value than One hundred and fifty pounds (exclusive of the cost of the site) and have a stone front approved by the Vendor or his Surveyor and built according to the building line shewn on the said plan and marked "building line" and face to Gardner Road and no building other than such dwellinghouses and outoffices thereto shall at any time thereafter be erected upon the said plot of land without the consent in writing of the Vendor. 6. The plans of every dwellinghouse or building to be erected upon the said plot of land or any part thereof shall be submitted to and be approved and signed by the Vendor or his Surveyor and no such dwellinghouse or building shall be built or commenced upon unless and until such plans have been so approved and signed and in the event of this condition not being complied with the Purchaser shall pay to the Vendor the sum of Twenty pounds for each and every building so erected as and for liquidated damages. 7. No building shall be erected upon the said plot of land of less than two storeys high and no building shall be used for any purpose which may cause any disagreeable smell or which may be noisy noisome or detrimental to the neighbourhood 8. One half of the gable walls of the buildings to be erected upon the said plot of land and of the side boundary walls of the said plot of land shall be placed on the adjoining land and shall be considered as party walls and one half the value of such walls shall be repaid to the Purchaser by the Purchaser or respective Purchasers of the adjoining land (if and when the same shall be sold) such value in case of dispute to be determined by the Vendor or his Surveyor and accepted by the respective parties as final and conclusive. NOTE: The building line follows the line of existing buildings.
