A Conveyance of the land in this title dated 7 July 1926 made between (1) Francis Moore, Norman Bancroft Thompson and Robert Wilton Nicholson (Vendors) and (2) William Spencer and Hannah Spencer (Purchasers) contains the following covenants:- "THE Purchasers for themselves and their successors in title hereby jointly and severally COVENANT with the Vendors their grantees and successors in title that they the purchasers their successors in title will at all times hereafter duly observe the said covenants and stipulations contained in the First Part of the Schedule hereto ......................................................................... THAT the open spaces between the building line and the road as shewn on the said plan (except where used for bay windows steps or porticoes which shall not project more than three feet from the said building line) shall never hereafter be built upon without the consent in writing of the Vendors and no building other than a dwellinghouse and the outoffices thereto shall at any time hereafter be erected on the said plot of land without the like consent Open Spaces not less than six feet in width between the said dwellinghouse and the northwesterly boundary of the said plot of land shall never hereafter be built upon without the consent of the Vendors except where used for bay windows steps or porticoes which shall not project more than three feet THAT no building to be erected on the said plot of land shall be used for any purpose which may cause any disagreeable smell or which may be noisy noisome or detrimental to the neighbourhood nor shall the same without the consent in writing of the Vendors be used for a shop or warehouse nor shall the sale of ale beer wine or spirituous liquors be carried on or permitted in any such building or in any manner upon the said plot of land without a like consent nor shall any poultry be kept upon the said plot of land THAT the Purchasers shall not erect any boundary walls or fences or spite boards to exceed five feet in height without the consent in writing of the Vendors such height to be measured from the garden path immediately opposbte the fence."
