A Transfer of the land in this title and other land dated 12 June 1995 made between (1) Thomas Ibison and (2) Bellway Homes Limited contains the following covenants:- "THE Purchaser so as to bind the whole and every part of the Property into whosoever hands the Property (or any Part thereof) may come covenants with the Vendor for the benefit of the whole and every part of the Retained Land as set out in the Third Schedule hereto but so that the Purchaser shall not remain liable for any breach of covenant occurring in respect of any land in which the Purchaser shall have ceased to have an interest. ......................................................................... 6. Not to interfere with the beech hedge Not to prune fell or otherwise interfere with any part of the beech hedge planted on the Retained Land appurtenant to the Property but the Purchaser shall be entitled pending construction of the Access Road to enter onto the area hatched brown on Plan no. 2 to facilitate the construction of the Access Road and if any part of the said beech hedge shall be thereby damaged to replace the same as soon as reasonably possible with like plants of comparable size. 5. Not to breach Town and Country Planning Regulations Not to breach any of the terms and conditions of any Town and Country Planning consent or Agreement governing the development of the Property or any part thereof.
