A Conveyance of the land in this title and other land dated 6 November 1929 made between (1) The Eagle Star & British Dominions Insurance Company Limited (Vendors) and (2) Samuel James Millard (Purchaser) contains the following covenants:- "COVENANT by the Purchaser for himself and his successors in title with the Vendors their successors and assigns that he will not use the said land first thereby conveyed except for business purposes only and that no house or building should be erected upon the said land other than such as should have been previously approved of by the L.M.S. Railway Company which was formerly the Furness Railway Company according to plans elevations and specifications to be submitted to the Company in duplicate and that no house or building for the time being on the said land should be used or suffered to be used for the exercise of carrying on of any offensive trade or business or for an Hotel Public House or Beer House or for the sale of any spirituous liquors or intoxicating liquors ........ and will indemnify the Vendors their successors and assigns from all loss damage or claims on account of the non observance of the said covenants and conditions or any of them subsequent to the date hereof" NOTE: The land in this title forms part of the property firstly conveyed. A Conveyance of the land in this title and other land dated 22 July 1938 made between (1) Samuel James Millard (Vendor) (2) James Melville and others and (3) Frank Sugden (Purchaser) contains the following covenants:- "Covenant by the Purchaser further with the Vendor for the benefit of the adjoining and neighbouring estate of the Vendor and the property of the Vendor in Bradford Street Chester Street and Grosvenor Street Ormsgill aforesaid that he the Purchaser and the persons deriving title under him would not carry on or permit to be carried upon any premises erected upon the piece of land thereby conveyed any trade or business whatsoever or use or permit the same to be used for any other purpose other than as a private dwellinghouse."
