A Conveyance of the land in this title and other land dated 28 April 1951 made between (1) Sir Cuthbert de Hoghton (Vendor) (2) Sir Charles William Beeston Prescott, The Right Honourable Charles Ughtred John Baron Shuttleworth and Mark Bonham - Carter (Trustees) and (3) Henry Frederick Bamber (Purchaser) contains the following covenants:- "FOR the benefit of the adjoining land of which the Vendor is tenant for life and so as to bind the property hereby conveyed the Purchaser hereby covenants with the Vendor that the Purchaser and the persons deriving title under him will henceforth perform and observe the covenants and stipulations following namely:- (1) Not to do or suffer or permit to be done or suffered thereon anything which may be or grow to be a nuisance annoyance or disturbance to the Vendor or his successors in Title or their lessees or tenants of the adjoining and neighbouring land of which he is tenant for life or to the neighbourhood (2) Not to place any operative machinery on any part of the property nor permit or suffer to be carried on thereon any noisome noxious or offensive trade or business and not to permit any hut shed caravan house on wheels or other chattel intended for use as a dwellinghouse or any show booths swings for public use or roundabouts to be placed thereon (3) Not to build or erect any buildings on the said land until the Purchaser shall have submitted to the agent for the time being of the vendor the plans elevations sections and specifications for such buildings or erections and until such plans shall have been finally approved and signed by the Vendor or his Agent the Purchaser paying the said Agents fee upon approval being granted (4) For ever to maintain all boundary fences in a good and substantial state of repair to the satisfaction of the Vendor or his Agent" By a Deed dated 8 March 2006 made between (1) Sir Richard Bernard Cuthbert De Hoghton, Francis Coussement Williams, Michael John Lowe and Lady Rosanna Stella Virginia De Hoghton (2) John Lambert and (3) The Royal Bank Of Scotland Plc the covenants contained in the Conveyance dated 28 April 1951 referred to above were expressed to be modified.
