The Covenant concerning the maintenance of sewers no longer applies as the property is now on mains water and drainage; Schedule of restrictive covenants 1 The following are details of the covenants contained in the Conveyance dated 24 August 1871 referred to in the Charges Register: Covenant by the said John Poole his heirs executors and administrators with the said William Gradwell his heirs and assigns 1 of 2 Title number CU19305 Schedule of restrictive covenants continued That he the said John Poole his heirs or assigns shall and would when and so soon as the several streets or roads to which the said hereditaments and premises thereby granted front or by which the same were bounded and the main sewers main drains lateral street drains and sewers which should be available for the said streets or which should be used for the purpose of draining the said hereditaments and premises should have been made and completed by the said William Gradwell his heirs or assigns pay unto the said William Gradwell his heirs or assigns such sum of money as should be apportioned by his or their Architect or Agent as the expense of making and completing such parts of the said streets drains and sewers as front to or bound or were used or available to or by the said hereditaments and premises thereby granted and should and would after such streets drains and sewers were completed keep in repair and clean or pay his or their proportion of the sum required for keeping in repair and cleaning the same in rateable proportion with the other owners of property facing thereto or using the same according to the amounts originally fixed to be paid by the said streets drains and sewers until the same should have been accepted by the Borough of Barrow in Furness and be repaired under their powers and authorities And that every dwellinghouse or building erected on the said plots of land on either of them should if attached to any other house or building have entire party walls on each side and that the owners for the time being of land adjoining to any wall should have liberty to make use of the same as a party wall by paying to the person or persons to whom such dwellinghouse or other building should belong one half the value thereof to the height to which the same height be used such value in case of difference to be settled by the said Architect of Agent and the yards or other divisional walls not forming the end of a dwellinghouse or building should be made use of and be party walls upon the like terms to the height of six feet from the surface of the ground and such walls after being so used should for ever thereafter be used enjoyed and maintained by the adjoining owners for the time being as joint and party walls to the height to which the same might be used.
