A Conveyance of the land in this title and other land dated 22 April 1902 made between (1) The Carnforth Hematite Iron Company Limited (Company) and (2) Edward Siddall Jackson (Purchaser) contains the following covenants and exceptions and reservations:- "Except and Reserving unto the Company the successors and assigns owners occupiers or tenants of the lands adjoining the said plot of land hereby conveyed full and free right and liberty at all times hereafter by day or by night and for all purposes with or without horses carts carriages or wagons laiden or unlaiden to go pass and repass and to drive cattle sheep and other animals along over and upon an intended New Road indicating on the said plan and thereon shaded blue The Purchaser doth hereby for himself his heirs executors administrators and assigns covenant with the Company their successors and assigns that the Purchaser his heirs and assigns will for ever hereafter leave open and unbuilt upon so much of the plot of land hereby conveyed as is comprised in the parts of the said plan hereupon drawn and shaded Blue as aforesaid to constitute and form a portion of the said intended New Road And will on demand pay a proportion according to the frontage of the said plot of land to such intended New Road of the expense incurred and to be incurred by the Company in forming making paving sewering and draining such road and shall until the same be taken over by the Local Authority pay the like portion of the expense of keeping the said road sewers and drains in complete repair and good conditin so far as the same are co-extensive of the said plot of land the said Company reserving to themselves their successors and assigns the liberty of entering upon the said plot of land for the purpose of forming making paving sewering and repairing the same intended New Road and of making and repairing the said sewers and drains and of using the said Road sewers and drains and of granting the use thereof to others for any purpose whatsoever and such proportion of the expenses aforesaid until paid shall be a charge upon the said plot of land hereby conveyed and the buildings thereon and shall be recoverable by distress in like manner as if it were for rent in arrear"> NOTE: The land coloured blue referred to is tinted blue on the title plan.
