A Conveyance of the land in this title dated 11 December 1964 made between (1) Turner and Norris Limited (Vendors) and (2) Terence Harkes and Muriel Harkes (Purchasers) contains the following covenants:- "THE PURCHASERS hereby jointly and severally covenant with the Vendors for the benefit and protection of the lands comprised in the Estate or any part or parts thereof other than the property hereby conveyed and so as to bind so far as may be the said property into whosesoever hands the same may come that they will observe and perform the restrictive and other covenants and conditions contained in the first Schedule hereto THE FIRST SCHEDULE before referred to Covenants by the Purchasers (a) To maintain and repair the walls and fences of the property where they are party walls and fences jointly with the adjoining owners and otherwise at their own expense in good and substantial repair and condition (b) Not to use the property or any building erected thereon or permit the same to be used for the purpose of any manufacture trade or business of any description or for any purpose other than a private dwellinghouse (c) Not to keep or permit to be kept on the said property or any part thereof any hens fowl rabbits or pigs and not to do or permit to be done any act matter or thing on or about the said property or any building thereon which shall be or may become a nuisance or annoyance to the Vendors or their successors in title owners or occupiers or any part of the Estate (d) Not to erect on the said property or any part thereof any garage premises other than of such design and constructed of such material as shall have first been approved by the Vendors Architect and any such garage premises shall be of permanent construction"
